{"id":241,"date":"2012-06-15T09:47:11","date_gmt":"2012-06-15T13:47:11","guid":{"rendered":"https:\/\/yourfaircreditlawyernow.com\/?p=241"},"modified":"2021-01-01T17:43:35","modified_gmt":"2021-01-01T22:43:35","slug":"obtain-a-free-copy-of-your-credit-report-after-a-credit-denial","status":"publish","type":"post","link":"https:\/\/yourfaircreditlawyernow.com\/?p=241","title":{"rendered":"Obtain A Free Copy of Your Credit Report After A Credit Denial."},"content":{"rendered":"<p>When a consumer\u00a0suffers an adverse action after applying for credit, the Fair Credit Reporting Act requires the user of the credit report to send the consumer a notification of the credit denial if that user took the adverse action in whole or in part because of information contained in the credit report.\u00a0 The credit denial letter has various requirements including notification of the reason(s) for the credit denial, notification of the credit reporting\u00a0agencies\u00a0that provided the user with the credit report, and notification that the consumer has the right to obtain a free copy of their credit report from the CRA.\u00a0 The full rights of the consumer can be found at <a title=\"1681m\" href=\"http:\/\/law.justia.com\/codes\/us\/2010\/title15\/chap41\/subchapiii\/sec1681m\/\" target=\"_blank\" rel=\"noopener\">15 U.S.C. 1681m(a).<\/a><\/p>\n<p>Given that <a title=\"1681j\" href=\"http:\/\/law.justia.com\/codes\/us\/2010\/title15\/chap41\/subchapiii\/sec1681j\/\" target=\"_blank\" rel=\"noopener\">15 U.S.C. 1681j(b)<\/a> of the FCRA requires a credit reporting agency to provide a consumer with a free copy of their credit report after credit denial, consumers should obtain\u00a0their credit file after receiving notice of the credit denial.\u00a0 To enforce this right, the statute requires that the consumer request the free report\u00a0within 60 days of receipt of the notification of credit denial.<\/p>\n<p>It is always good to review a copy of your credit file even if you think you know the source of your credit problems.\u00a0In many instances,\u00a0consumers have derogatory credit accounts on their credit report that belong to\u00a0another consumer,\u00a0unauthorized accounts,\u00a0or accounts that are reporting\u00a0too\u00a0much negative information for the circumstances.\u00a0 Carefully review all of the accounts that appear on your credit report.\u00a0 For suggestions on how to review the contents of your credit report, please see my prior post on the topic of <a title=\"How to Examine Your Consumer Report For Inaccuracies\" href=\"https:\/\/yourfaircreditlawyernow.com\/?p=187\">how to\u00a0examine your credit report<\/a>:<\/p>\n<p>Finally, adverse action letters can be your first notification that you have been the victim of identity theft.\u00a0 If a consumer has an existing credit line and the bank closes that credit line because of derogatory credit references, the\u00a0bank must send you notice of that adverse action including the identity of the credit reporting agency that provided the creditor with the credit report.\u00a0 For identity theft victims, the derogatory identity theft related accounts will cause their creditors to close or limit existing credit lines because of the change in credit history.\u00a0 Accordingly, a consumer should never ignore a notice of credit denial letter because it can be the first clue that an identity theft problem exists.\u00a0\u00a0Remember that are important\u00a0items to consider if <a title=\"Help, I MIGHT have been a victim of identity theft!\" href=\"https:\/\/yourfaircreditlawyernow.com\/?p=118\">you\u00a0may have been the victim of identity theft<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>When a consumer\u00a0suffers an adverse action after applying for credit, the Fair Credit Reporting Act requires the user of the credit report to send the consumer a notification of the credit denial if that user took the adverse action in whole or in part because of information contained in the credit report.\u00a0 The credit denial &hellip;
